Diddy’s conviction is currently being reviewed by an appeals court, and his lawyers are making two arguments that could set him free.
Argument 1 – First Amendment protection: His lawyers claim the “freak-offs” were essentially private amateur pornography — consensually filmed, never distributed, and made purely for personal enjoyment. Since Diddy actually paid the participants (meaning no profit was made), they argue there was no commercial purpose, which is what the Mann Act was designed to target. And since private porn is constitutionally protected, they say prosecuting him under the Mann Act was unconstitutional.
Argument 2 – The sentence was too harsh: The typical Mann Act sentence is around 15 months, but Diddy got 50. His lawyers argue the judge was influenced by evidence from charges Diddy was acquitted of — like racketeering and sex trafficking — including the Cassie video. They say the judge should have only considered the Mann Act violation itself.
The key detail: Diddy has already served 19 months. So if the appeals court agrees with either argument — that it was protected speech, or that 15 months was the right sentence — he walks free immediately.
The judges are hearing arguments now but likely won’t rule on the spot. A written decision is expected soon.
